These General Terms and Conditions of Sale govern the conditions applicable to sales
concluded between, on the one hand, any user of the website https://www.muslimcosmetic.com making apurchase via the site, hereinafter referred to as "the Customer" and, on the other hand, "the Seller",
The Client and the Seller are hereinafter referred to as "the Parties".
These conditions apply exclusively to non-professional individuals.
Purchasing a Product through this site implies unreserved acceptance of theGeneral Terms and Conditions of Sale.

Directly and automatically online, the Customer's electronic acceptance marks the conclusionof the contract between the Customer and the Seller. In accordance with the law of March 13, 2000 onelectronic signatures and the law on confidence in the digital economy of June 21, 2004, any purchase validatedby the Customer by their "double click" or by their agreement over the phone constitutes anirrevocable acceptance of these general terms and conditions by the Customer, just like a handwritten signature.
The general terms and conditions of sale are concluded for the duration necessary for the sale of the Products,until the expiry of their warranties.
The Customer selects the Product(s) they wish to purchase and can accesstheir order summary at any time. The Customer has the option to modify their order and correctany errors before final confirmation.
Receipt of final payment for the order by muslimcosmetic.com, after confirmation of theorder summary by the Customer, concludes the sales contract between the Customer and the seller. Thiscontract can only be challenged within the limits stipulated in the General Terms and Conditions of Sale (GTC).Placing an order implies the Customer's unreserved acceptance of the GTC.
The order confirmation will be sent to the Customer by email. Depending on thepayment method used, the order confirmation may be delayed untilmuslimcosmetic.com has received final payment.
For this purpose, the Customer formally accepts the use of email for confirmation bythe seller of the contents of their order.
Muslimcosmetic.com reserves the right to refuse orders from a Customer with whomthere is a dispute or incident relating to the payment of a previous order under theconditions detailed in article 4.2 below.

Article 3 – Price

 
3.1 Prices are shown in euros excluding tax. ("VAT not applicable - Article 293 B of the French General Tax Code")
3.2 The Seller reserves the right to change the price of items at any time, but itemswill be invoiced based on the rates in effect at the time of order validation, subjectto availability.
3.3 Items and any charges will be billed based on the rates in effect at the timethe order is registered.
3.4 Retention of Title Clause: the products remain the property of the Seller until
full payment of the price.

Article 4 – Order – Validation

 
4.1. Personal Information
When placing an order, the Customer agrees to provide the requested information andwarrants its accuracy:

Unless proven otherwise, the data recorded by the Seller constitutes proof of alltransactions.
The Customer must verify all the information entered during the ordering process (productordered, delivery address, billing address, telephone number, etc.). The Customermust also verify the information contained in the order confirmation email.
The Seller cannot be held responsible for any errors made by the Customer when entering information, nor for anyresulting delays or delivery errors. Therefore, if delivery cannot becompleted due to an error made by the Customer when entering information, the Customer will be responsible for the reshipment costs.
4.2. Confirmation and sending emails
The Seller sends an order confirmation email to the Customer to summarize thecontractual information.
The Customer's order is then validated by the Seller's Services according to thepayment validation procedures described in these general terms and conditions of sale, the Customer receives anew email informing them of the date of shipment of their order.
The order placed by the Customer consists of products from the online cataloguecompiled by the Seller.
An order can only be registered on the website if the Customer is clearly identified. To do this, thecustomer is asked to provide their full name, a valid email address,postal address, preferred telephone number for contacting the delivery driver, anddate of birth. The Seller reserves the right to cancel an order from a Customer who,in its opinion, presents any form of risk or with whom there is an existing dispute concerningpayment for a previous order.
All orders constitute acceptance of the prices and descriptions of the products available for sale.Orders are payable only in euros excluding VAT.
The Seller undertakes to fulfill orders received within the limits of availableProduct stock.
The sales dates indicated on the website are the dates in effect in France.

Article 5 - Availability

 
5.1 The Seller's Product offers and prices are valid as long as they are visible on the site, within thelimits of available stock.
5.2 For Products not available from the Seller, the Seller's offers are valid subjectto availability from the Seller's suppliers.
5.3 In the event that a Product becomes unavailable after the Customer has placed an order, theSeller will inform the Customer by email as soon as possible. The Customer's order will beautomatically cancelled and the Customer refunded under the conditions specified in Article 10.8.
5.4 The availability information provided at the time of ordering is indicative only,as Products are only reserved after payment of the order. Orders pendingpayment that are settled late after order registration may therefore havethe stock of the ordered Product(s) modified or rendered unavailable. In the event of a stock shortage, the Sellerundertakes to contact the supplier to determine the delivery time of the ordered product andwill inform the Customer immediately.
If the Customer decides to cancel their Order for unavailable Products, they will receive the
refund of all sums paid for unavailable Products no later thanfourteen (14) days following the date on which the contract was issued.

Article 6 - Delivery

 
6.1 Delivery is made in metropolitan France and in European countries.
6.2 Delivery charges to France and European countries will be charged according to themarket prices observed for each destination.
Secure delivery against loss and theft is also available.
6.3 muslimcosmetic.com or the selected carrier cannot be held responsible fordelivery delays or non-delivery if the Customer has not provided acomplete and correct delivery address. A reshipment fee of €6.90 will be charged to the Customer for any package that could not be delivered due to an incomplete or incorrectdelivery address.

Two delivery options with home/collection point tracking are available: -
Colissimo home delivery -Mondial Relay collection point and home delivery

Delivery time depends on the carrier and the type of product; a duration of between 2 and6 days is to be expected depending on the delivery method and the selected destination.
Fast/secure delivery is a priority/loss before the "delivered" status.
Any customs fees are the responsibility of the customer.muslimcosmetic.com is responsible until the product is delivered to the customer. Please note that the
The customer has three (3) days to notify the carrier of any damage orpartial loss observed during delivery.
6.4 Muslimcosmetic.com undertakes to respect a preparation time of between 24 to 72 hours fordelivery by Colissimo and Mondial Relay from the date of positive evaluation ofpayment byBank Card.
6.5 In the case of products deliverable on different dates taking into account their availability, thedelivery time is based on the longest time.
6.6 Upon receipt of the order, the Seller recommends that the Customer check the conformity of theirorder and inform the Seller of any anomalies within 24hours. After this period, muslimcosmetic.com cannot be held responsible for a non-conforming delivery.

Article 7 - Prerequisites for placing an order

 
Ordering a Product by an individual on the Site is reserved for persons aged atleast 18 years, capable of contracting and acting for legal purposes.
The Customer guarantees that they have truthfully provided the information requested during registration. Before using the Site, the Customer must ensure they have the necessarytechnical and computer resources to use the Site, order Products, and that theirbrowser allows secure access to the Site.
The Client expressly agrees not to use false information or information fromthird parties.
After their first order and for subsequent orders, the Customer can accesstheir account by entering their username and password. Article 10 - Guarantees & Right of Withdrawal

 
10.1 Guarantee of conformity
Article L. 217-4 of the Consumer Code: "The seller delivers goods that conform to the contract andis liable for any lack of conformity existing at the time of delivery.
He is also liable for defects in conformity resulting from packaging, assembly instructionsor installation when the latter was his responsibility under the contract or was carried out under hissupervision.
Article L.217-5 of the Consumer Code: "The goods conform to the contract:
1° If it is fit for the purpose usually expected of a similar good and, where applicable: -if it corresponds to the description given by the seller and possesses the qualities that the latterpresented to the buyer in the form of a sample or model; - if it possesses the qualities that a buyer can legitimately expect in view of thepublic statements made by the seller, by the producer or by his representative, in particular inadvertising or labelling;
2° Or if it possesses the characteristics defined by mutual agreement between the parties or is suitable forany special purpose sought by the buyer, brought to the seller's attention andaccepted by the latter.muslimcosmetic.com is liable for any lack of conformity existing at the time ofdelivery and for any lack of conformity resulting from the packaging, assembly instructions, orinstallation when the latter was carried out by the seller or under its responsibility.
The action resulting from a lack of conformity is time-barred two (2) years from the date of delivery of theProduct (Article L.217-12 of the French Consumer Code). In the event of a lack of conformity, the Customermay request, at their discretion, either a replacement or a refund of the Product.If a replacement is impossible, muslimcosmetic.com undertakes to refundthe price of the Product within thirty (30) days of receiving the returned Product, provided thatthe Customer returns the Product to the email address provided by customer service:muslimcosmetic@gmail.com
The implementation of the legal guarantee of conformity must not entail any costs for the buyer(Article L. 217-11 of the Consumer Code).
10.2 Warranty against hidden defects
The Seller undertakes to exchange or refund any Product with hidden defects,non-conformity resulting from packaging and quality problems during normal use of theProduct, in accordance with articles L.217-4 to L.217-14 of the Consumer Code.
The return shipping costs will then be borne by the Seller. The Buyer cannot cancel the sale ifthe non-conformity is minor.muslimcosmetic.com is bound by the warranty due to hidden defects in the Product sold.
renders the product unfit for its intended use, or so diminishes its usefulness that the customerwould not have purchased it, or would have paid a lower price, had they been aware of the defects. In the event that a replacement or repair is impossible, muslimcosmetic.comundertakes to refund the price of the Product within thirty (30) days of receiving the returned Product, provided thatthe Customer returns the Product to the email address provided by customer service:muslimcosmetic@gmail.com
The action resulting from latent defects must be brought by the Client within two (2)years from the discovery of the defect. (Paragraph 1 of Article 1648 of the Civil Code).

In accordance with applicable legal provisions regarding product conformity andhidden defects, defective products (through no fault of the Buyer) or products that do notmatch the order will be refunded or exchanged at the Buyer's discretion.Products must be returned in the condition in which they were received, with allcomponents (accessories, instructions, etc.) in packaging suitable for safe transport.
These guarantees are without prejudice to the right of withdrawal provided for in Article 4. It is reminded that underthe legal guarantee of conformity, the Buyer:
benefits from a period of two years from the delivery of the goods to take action;
may choose between repair or replacement of the goods, subject to the cost conditionsprovided for in Article L. 217-9 of the Consumer Code;
Finally, the Customer is exempt from providing proof of the existence of the Product's non-conformityduring the twenty-four (24) months following delivery of the Product, except forsecond-hand goods for which this period is set at six (6) months. (Article L. 217-7 of the Consumer Code).
The legal guarantee of conformity applies to the commercial guarantee that may
possibly cover the Product. It is reminded that the Buyer may decide to implement theguarantee against hidden defects of the thing sold within the meaning of article 1641 of the civil code and thatin this case, he may choose between the rescission of the sale or a reduction of the sale pricein accordance with article 1644 of the Civil Code.
In all cases, defective products must be repaired or replaced at no cost tothe consumer. This principle of free service also applies to the cost of returning the product.
Any return due to the Customer resulting in external postal costs cannot be covered bythe Seller if the Seller has not been informed beforehand.
Order error:
In the event of an error in the model or product during order preparation, the Selleragrees to exchange the product. Return and reshipping costs will be borne by the Seller.
Return due to Customer:
The Customer has a legal right of withdrawal of 14 calendar days from the date ofreceipt of the Products. Return shipping costs are the responsibility of the Customer.
In the event that the Customer has ordered several Products via a single Order resultingin several Deliveries (or in the case of an Order of a single Product delivered in several batches ofparts), the withdrawal period will expire fourteen (14) days after the day on which you, or a third partyother than the carrier and designated by you, takes physical possession of the last good, thelast batch or the last part.
To exercise their right of withdrawal, the Customer must notify their decision to withdraw by meansof an unambiguous statement to muslimcosmetic@gmail.com, in particular thewithdrawal form available here .
In order for the withdrawal period to be respected, the Customer must send their communication relating tothe exercise of the right of withdrawal before the expiry of the withdrawal period.
In the event of withdrawal by the Customer, muslimcosmetic.com undertakes to reimburse allsums paid, including Delivery costs, without undue delay, and at the latest withinfourteen (14) days from the date on which it is informed of the Customer's decision to withdraw(Article L.221-24 of the Consumer Code).

Exclusions from the rightof withdrawal: Theright of withdrawal is excluded in the following cases : on the financial market

Supply of goods made to the Customer's specifications or personalized. Supply of goods liable to deteriorate or expire rapidly.

Supply of sealed audio or video recordings or software which have been unsealed after delivery; newspaper, periodical, magazine (except subscription contract)

Provision of accommodation services other than for residential purposes, transport of goods, car rental, catering or services related to leisure activities if the offer specifies a date or period of performance.

Supply of goods which by their nature are inseparably mixed with other items

Supply of alcoholic beverages whose price was agreed upon at the time of conclusion of the sales contract, whose delivery can only be made after 30 days and whose actual value depends on market fluctuations beyond the seller's control

 Supply of digital content not supplied in a tangible manner if performance has begun with the consumer's prior express consent, who has also acknowledged that they will thereby lose their right of withdrawal

Upon receipt of the package, the Seller will assess the perfect condition of the products (packaging, accessories, instructions, etc.).
No returns will be accepted if the returned Products have been visibly worn, damaged, used,or their packaging damaged or deteriorated, rendering the product unsuitable for resale innew condition.
If the return is refused by the Seller, the Products will be returned to the Customer at the Seller's expense withoutthe Customer being able to claim any refund or compensation.
Exchange :
The Customer has 14 days from the date of receipt to return the Products andrequest an exchange. Return shipping costs will be borne by the Customer.
Refund :

Article 16 - After-sales service (ASS) - Terms ofsale

 
All our products benefit from the legal guarantee of conformity and the guarantee against hidden defects.
The cost of sending the product(s) to the workshop is covered by muslimcosmetic.com. For anyreturn, the customer must send the package back to muslimcosmetic.com at the email address providedby customer service: muslimcosmetic@gmail.com. The Seller will follow up withsuppliers in the event of any necessary repairs.
Whatever the problem encountered with the Product, the customer must first attachphotographic/video evidence of the problem, mentioning the order number, by email.
All Products sold also benefit from the legal guarantees provided by law.
Non-compliance defines the following situations:
Good unfit for the purpose for which similar goods are normally used (for example, product
(usually designed to work wirelessly on battery power, but ultimately needs to be plugged intomains power)
Item that does not match the description given by the seller even if it works perfectly(for example, the color does not match the model shown)
A product that does not possess the qualities advertised by the seller or agreed upon with you (for example,a cooker hood presented as particularly quiet turns out to be noisy).
A product that has a manufacturing defect, an imperfection, or poor assembly
Improper installation by the seller or an incomplete orincomprehensible installation manual will prevent you from properly assembling the appliance. The defects maystem from:

assembly instructions,
of the installation when it was carried out by the seller or under their responsibility.
However, the legal guarantee of conformity does not apply if:
You were aware of the defect at the time of purchase.
you could not ignore the defect at the time of purchase (for example, if the seller informed you of it),the defect resulting from materials that you supplied or added (for example, if you put anon-compliant battery in your phone).

 
Article 17 - FORCE MAJEURE

 
Muslimcosmetic.com cannot be held liable if the non-performance ordelay in the performance of any of its obligations described in these Terms and Conditions arises from acase of force majeure.
There is force majeure in contractual matters when an event beyond the control of thedebtor, which could not reasonably have been foreseen at the time the contract was concluded and whoseeffects cannot be avoided by appropriate measures, preventsthe debtor from performing his obligation.
If the impediment is temporary, performance of the obligation is suspended unless theresulting delay justifies termination of the contract. If the impediment is permanent, the contract isautomatically terminated and the parties are released from their obligations under the conditions set forth inArticles 1351 and 1351-1 of the Civil Code.
In the event of the survival of the aforementioned event, muslimcosmetic.com will endeavor to inform the
Client as soon as possible.
